OFFICIAL REGULATION ON GRANTING THE COMMERCIAL DURABILITY WARRANTY – 3 YEARS
(valid for purchases starting from 01.03.2026)
SECTION 1. ISSUER
(1) The commercial durability warranty of 3 (three) years is offered by GOLDEN FISH SRL, headquartered in Stefanestii de Jos, Ilfov, registered at the Trade Register under no. J2016002652233, having TIN (CUI) 22908031, hereinafter referred to as the “Manufacturer.”
(2) This Regulation establishes the conditions applicable to the commercial durability warranty of 3 (three) years and is available free of charge on the Manufacturer’s website, at: https://www.micul-fermier.ro/info/5-ani-garantie
(3) The Manufacturer reserves the right to amend this Regulation, under the conditions and in compliance with the provisions of Section 20.
SECTION 2. SCOPE OF THE REGULATION
(1) This Regulation governs the conditions for granting the commercial durability warranty of 3 (three) years.
(2) The commercial durability warranty, hereinafter the extended warranty, is a commercial warranty granted in addition to the legal conformity warranty and is intended to ensure, as applicable, the repair or replacement of the product, in accordance with this Regulation.
(3) The extended warranty does NOT affect, does NOT limit, and does NOT exclude the Consumer’s rights conferred by the legislation on the legal conformity warranty.
SECTION 3. DEFINITIONS
For the purposes of this Regulation, the following terms have the meanings set out below:
a) Consumer: a natural person who purchases products for personal use, outside commercial, industrial, professional, or resale activities.
b) Legal conformity warranty: the warranty provided by the legislation in force – Emergency Government Ordinance no. 140/2021 on certain aspects relating to contracts for the sale of goods, during the first 2 (two) years from delivery.
c) Commercial durability warranty: a warranty voluntarily offered by the Manufacturer, extending the conformity warranty for an additional period of 3 (three) years, so that the consumer will benefit from a total warranty period of 5 years from delivery.
d) Eligible product: a product included in the list of products eligible for the commercial durability warranty, published on the website.
e) Fiscal receipt: a fiscal document issued at the time of purchase, mandatory for the granting and exercise of the rights related to the commercial durability warranty.
f) Authorized service center: a service unit designated by the Manufacturer, authorized for the assessment and repair of the product.
g) Manufacturing defect: a defect that has occurred due to materials or the manufacturing process, under normal household use conditions.
h) Consumables: parts/accessories subject to normal wear and with a limited lifespan, which require periodic replacement (e.g., batteries, blades, drill bits, discs, filters, collection bags, chains, etc.).
i) Professional use: the use of the product in commercial, industrial, service provision, or any income-generating activities, regardless of frequency.
SECTION 4. LEGAL BASIS
(1) This Regulation is drawn up in accordance with the applicable legislation of Romania, including but not limited to:
EGO no. 140/2021 on certain aspects relating to contracts for the sale of goods; GO no. 21/1992 on consumer protection; EGO no. 34/2014 on consumer rights in contracts concluded at a distance; Regulation (EU) 2016/679 (GDPR) and related national legislation.
(2) In case of discrepancies between this Regulation and mandatory legal provisions, the legal provisions shall prevail.
SECTION 5. PERIOD OF APPLICATION
(1) The commercial durability warranty of 3 (three) years applies exclusively to products from the list of eligible products purchased starting from March 1, 2026.
(2) Products purchased before 01.03.2026 are not covered by this Regulation.
(3) The Manufacturer may decide to cease granting the extended warranty for certain products/categories; however, the cessation shall not affect the rights acquired for eligible products purchased during the application period, under the conditions of this Regulation.
SECTION 6. BENEFICIARIES / ELIGIBILITY
(1) The extended warranty is granted exclusively to Consumers (natural persons).
(2) The following categories are excluded from the extended warranty:
a) legal entities; b) sole traders / individual enterprises / family enterprises / NGOs; c) purchases made for professional, industrial, agricultural, or commercial purposes; d) products used for service provision, rental, or income-generating activities; e) products purchased for resale.
(3) The Manufacturer reserves the right to refuse the extended warranty if there are reasonable indications that the product was purchased or used for professional purposes.
SECTION 7. ELIGIBLE PRODUCTS (LIMITED NUMBER)
(1) The extended warranty applies only to products included in the list of eligible products established by the Manufacturer.
(2) The list of eligible products is published and updated on the website at: https://www.micul-fermier.ro/catalog/5-ani-garantie-888
(3) The absence of the product from the published list automatically results in ineligibility.
(4) The Manufacturer reserves the right to modify the list of eligible products, applicable to purchases made after the date of the update.
SECTION 8. PROOF OF PURCHASE (MANDATORY CONDITION)
(1) To benefit from the extended warranty, the Consumer must retain and present the fiscal receipt for the purchase.
(2) The fiscal receipt must be legible and contain at least: the date of purchase; the name/code of the product; the name of the seller; the amount paid.
(3) In the absence of the fiscal receipt, the extended warranty is NOT granted and CANNOT be claimed.
(4) The following are not accepted as substitutes: AWB, courier receipts; email confirmations; bank statements; screenshots without fiscal character.
SECTION 9. WARRANTY DURATION (2 YEARS + 3-YEAR EXTENSION)
(1) The total warranty duration is 5 years calculated from the date of purchase recorded on the fiscal receipt.
(2) During the first 2 (two) years from delivery, the legal conformity warranty applies.
(3) After the expiry of the 2 (two) year legal conformity warranty period, the commercial durability warranty applies for an extended period of 3 (three) years, until the completion of the total term of 5 years, under the conditions of this Regulation and the Commercial Durability Warranty Certificate.
(4) The extended warranty is valid exclusively on the territory of Romania, unless the Manufacturer provides otherwise.
SECTION 10. METHOD OF GRANTING THE EXTENDED WARRANTY
(1) The extended warranty is granted for eligible products if the following conditions are cumulatively met:
a) the product is purchased starting from 01.03.2026; b) the product is included in the list of eligible products; c) the purchase is made by a natural person; d) the Consumer can present the fiscal receipt; e) the conditions of the Commercial Durability Warranty Certificate are met in order to activate the commercial warranty.
(2) The Manufacturer does not condition the granting of the extended warranty on the completion of an online form or product registration.
SECTION 11. CONSUMER RIGHTS UNDER THE EXTENDED WARRANTY
(1) During the extended warranty period, the Consumer is entitled, under the conditions of this Regulation, to:
free repair of the product; or replacement of the product if repair is not possible.
(2) The applicable solution is determined by the Manufacturer and/or the authorized service center, following a technical assessment.
(3) Product replacement may be carried out with: an identical product (same model), if available; an equivalent product in terms of functionality and value, if the model is no longer available or no longer marketed.
SECTION 12. WHAT THE EXTENDED WARRANTY COVERS
(1) The extended warranty covers exclusively manufacturing defects and/or material defects that have occurred under normal household use conditions.
(2) The following situations are considered, by way of example and without limitation, as cases that may be covered: motor failure under normal conditions; defects in internal components that have occurred without external intervention; defects in electronic boards or internal elements; defects in internal mechanical elements, provided they are not consumables.
(3) The Manufacturer reserves the right to request a technical assessment at an authorized service center before approving the remedy under the extended warranty.
(4) The extended warranty does not cover repairs carried out without a technical assessment, except in cases where the Manufacturer expressly approves an alternative solution.
SECTION 13. CONSUMER OBLIGATIONS
To maintain the right to the extended warranty, the Consumer is obligated to:
a) retain the fiscal receipt for the entire duration of the warranty; b) use the product in accordance with the manual and instructions; c) perform the recommended periodic maintenance; d) not use the product in a professional capacity; e) not tamper with the product (unsealing, modification); f) use compatible and recommended accessories; g) keep the product serial number intact and visible (if the product has a serial number); h) present the product in a condition that allows technical inspection under safe conditions.
SECTION 14. EXCLUSIONS – SITUATIONS NOT COVERED BY THE EXTENDED WARRANTY
(1) The extended warranty does NOT cover defects or deterioration resulting from:
14.1 Consumables and Normal Wear
Blades, discs, drill bits, chains, belts, rollers, filters; collection bags, nozzles, gaskets; carbon brushes; parts that wear naturally through use; cosmetic deterioration (scratches, discoloration, normal signs of use).
14.2 Products with Batteries (Battery/Charger Exclusion)
For battery-powered equipment, the extended warranty applies to the equipment, NOT the battery and NOT the charger, unless otherwise specified in the list of eligible products. The battery is considered a consumable.
14.3 Improper Use / Overloading
Use contrary to the manual; overloading; continuous use beyond the recommended regime; use in unsuitable environments (excessive dust, extreme humidity, non-compliant temperatures).
14.4 Accidental Damage
Falls, impacts, mechanical shocks; cracks, deformations, breakage of components; damage caused by improper handling.
14.5 External Factors
Fires, floods, storms, hail; liquid penetration; oxidation/rust; pests/insects; exposure to extreme temperatures.
14.6 Incorrect Power Supply
Incorrect voltage, fluctuations, power surges; connection to non-compliant installations; use of defective extension cords; wrong fuel / incorrect mixture (where applicable).
14.7 Unauthorized Interventions
Repairs performed outside the authorized service center; unsealing; structural modifications; use of non-original/incompatible parts.
14.8 Missing Mandatory Documents
Missing fiscal receipt; illegible receipt; impossibility of identifying the product (serial number erased/damaged, where applicable).
(2) The Manufacturer may refuse to grant the extended warranty if, following verification, it is determined that the defect is not a manufacturing defect.
SECTION 15. LOSS OF THE EXTENDED WARRANTY
(1) The extended warranty is considered void or no longer applicable in the following cases:
a) the fiscal receipt is missing; b) the product serial number is erased, damaged, or altered (if the product has a serial number); c) the product is used professionally/commercially; d) the product has been repaired/modified by unauthorized persons; e) the product has been accidentally damaged; f) the product shows signs of liquid penetration, severe oxidation, or burns; g) the product has been used with incompatible accessories.
(2) The Manufacturer cannot be held liable for defects that subsequently arise as a result of any of the above situations.
SECTION 16. PROCEDURE FOR REQUESTING THE EXTENDED WARRANTY
16.1 Initiating the Request
(1) In the event of a defect, the Consumer may initiate a warranty claim by: presenting the product at the authorized service unit; sending a request to: online@micul-fermier.ro; calling: 0374 496 500; completing the contact form on the website.
16.2 Required Documents
(1) The Consumer must provide: fiscal receipt; the product (or defective component); description of the problem; contact details.
(2) The Manufacturer may request additional information to identify the product or the cause of the defect (e.g., photographs, product serial number, relevant accessories).
16.3 Product Handover
(1) The product must be handed over in a condition that allows the defect to be assessed.
(2) The Consumer must hand over the product together with the components necessary for testing (e.g., charger, cables, accessories essential for operation).
(3) Excessively dirty products (mud, cement, oil, compacted dust, etc.) may be temporarily refused until minimal cleaning, to allow technical inspection under safe conditions.
16.4 Technical Assessment
(1) The product is analyzed by the authorized service center to determine: the existence of the defect; the cause of the defect; eligibility under the extended warranty.
(2) If the defect is not confirmed, the Manufacturer may return the product without performing the repair.
SECTION 17. RESOLUTION TIMEFRAME
(1) The standard resolution timeframe is a maximum of 15 calendar days from the date the product is received by the service center.
(2) In justified situations (unavailable parts, import, shipment to the manufacturer, high volume of requests), the timeframe may be extended, with prior notification to the Consumer.
(3) The resolution timeframe may be influenced by the availability of spare parts or the complexity of the defect.
SECTION 18. REMEDIATION METHODS
(1) Depending on the assessment, the Manufacturer may apply one of the following measures:
a) Repair: replacement of defective components and restoration of the product to working condition; b) Replacement: with an identical or equivalent product.
(2) If the non-conformity is remedied through replacement, for the goods that replace the non-conforming goods, the time period provided in the commercial durability warranty begins to run from the date of replacement.
(3) If the non-conformity is remedied through repair, the time period provided in the commercial durability warranty is extended by the downtime of the product, from the moment the Manufacturer was informed of the lack of conformity until the effective handover of the product in a state of normal use to the consumer.
SECTION 19. FEES AND COSTS
(1) Beneficiaries of the 3-year extended warranty are not required to pay any additional fees to the Organizer for the granting of this commercial warranty, under the conditions of this Regulation.
(2) The granting of the extended warranty is free of charge and applies to eligible products purchased starting from 01.03.2026.
(3) If the defect is confirmed as being covered by the extended warranty, the diagnostic and repair costs shall be borne by the Organizer.
(5) If the defect is not covered, the Manufacturer may request the Consumer to bear the costs of diagnostics/transport/labor, after prior notification to the Consumer.
SECTION 20. PUBLICATION OF THE REGULATION AND AMENDMENTS
(1) This Regulation is published on the Manufacturer’s website and may be consulted free of charge by consumers.
(2) The Manufacturer reserves the right to amend this Regulation whenever it deems necessary, with publication of the updated version on the website.
(3) Updated versions apply to purchases made after the date of their publication.
(4) Amendments do not affect the rights of Consumers for products purchased prior to the amendment, if they were eligible at the time of purchase.
SECTION 21. FORCE MAJEURE
(1) For the purpose of this Regulation, “Force Majeure” means any external, unforeseeable, absolutely insurmountable and unavoidable event that cannot be controlled, remedied, or foreseen by the Manufacturer and whose occurrence renders the Manufacturer unable to fulfill the obligations assumed under this Regulation.
(2) Such events include, without limitation: wars, armed conflicts, terrorist acts; fires, explosions, floods; earthquakes and other natural disasters; strikes, blockades, massive disruptions of supply chains; epidemics/pandemics; administrative restrictions imposed by authorities; major disruptions of transport, communication, or utility networks; any regulation that appears after the entry into force of this Regulation that may prohibit or modify its application.
(3) In the event of a Force Majeure situation that prevents or delays, in whole or in part, the application of this Regulation, the Manufacturer shall be exempt from liability for the fulfillment of its obligations for the duration of the event, in accordance with the applicable provisions of the Civil Code of Romania.
(4) The Manufacturer shall inform consumers about the occurrence of Force Majeure within a reasonable time, by publishing a notice on the Manufacturer’s official website, in the section dedicated to the extended warranty.
(5) If Force Majeure results in the definitive impossibility of applying certain provisions of this Regulation, the Manufacturer reserves the right to amend or cease its application, with prior public notification, without affecting requests already in progress, to the extent that this is possible.
SECTION 22. LIMITATIONS OF LIABILITY
(1) The Manufacturer is not responsible for: indirect losses; loss of use of the product; damages resulting from incorrect use; deterioration occurring during transport carried out by the Consumer without proper packaging.
(2) The Manufacturer is not liable for accessories subsequently installed by the Consumer or for unauthorized modifications to the product.
(3) The Manufacturer is not liable for any damages caused by the use of the product for purposes other than those specified in the user manual.
SECTION 23. PERSONAL DATA PROTECTION (GDPR)
(1) In the context of applying the 5-year extended warranty, the Manufacturer may process personal data belonging to Consumers who request interventions, assessments, or services under the warranty.
(2) The personal data processed may include, without limitation: first and last name; home address (if necessary for delivery/transport); telephone number; email address; information about the purchased product (model, serial number, date of purchase); information about the purchase document (fiscal receipt); information about the history of technical interventions, if applicable.
(3) The data is processed exclusively for the purpose of: verifying product eligibility and compliance with warranty conditions; resolving service requests; performing product repair/replacement; communicating with the Consumer regarding the status of the request; fulfilling legal accounting and fiscal obligations, as applicable; managing complaints and disputes.
(4) The Manufacturer may transmit personal data to contractual partners involved in resolving the request (e.g., authorized service center, courier/transport companies), strictly to the extent necessary for the provision of the requested services.
(5) Personal data shall be retained for the period necessary to resolve requests and subsequently, in accordance with the applicable legal deadlines.

(7) By submitting a warranty request, the Consumer acknowledges that they have read the provisions of this section.
SECTION 24. DISPUTES
(1) In the event of disputes arising between the Manufacturer and Consumers in connection with the application of this Regulation, they shall be resolved amicably.
(2) The Consumer may submit a complaint or request for clarification to the Manufacturer through the contact channels available on the website (telephone/email).
(3) If amicable resolution of disputes is not possible, the parties involved shall submit the dispute for resolution to the competent courts in Romania.
(4) This Regulation is governed by Romanian law.
SECTION 25. FINAL PROVISIONS
(1) This Regulation applies exclusively to products: purchased starting from 01.03.2026; eligible according to the list published on the website; purchased by natural persons; proven by fiscal receipt.
(2) The purchase of an eligible product and the request for warranty service implies acceptance of this Regulation.
(3) This Regulation is drafted in the Romanian language. In the event of translated versions, the Romanian version shall prevail.
