I. About Us

E-fishent SRL (“E-FISHENT”), with its registered office at Linia de Centura no. 5, CTPark Bucharest North Industrial Park, Unit D, ground floor, Space D1, office no. 27, Stefanestii de Jos, Ilfov, registered at the Trade Register under no. J23/4049/2018, having TIN (CUI) RO39795280, manages and administers the subsection addressed exclusively to consumers, available on the website https://www.micul-fermier.ro/

Https://www.micul-fermier.ro is a subsection of the Micul Fermier online platform that offers its customers, both natural and legal persons, the possibility to purchase the products sold within it. Product purchases are made based on orders received through the website or by telephone.

 

II. Definitions

Order – an electronic document through which the User transmits to the Seller their firm intention to purchase the Products indicated therein.

Customer Account – the section of https://www.micul-fermier.ro consisting of an email address and a password that allows the User to place an Order and that contains information about the User, as well as the history of Orders placed on https://www.micul-fermier.ro. The User is responsible and shall ensure that all information in the Account is correct, complete, and up to date.

Contract – the distance contract concluded between the Seller and the User, without the simultaneous physical presence of the Seller and the User.

Cart – the section of https://www.micul-fermier.ro that allows the User to add the Products they wish to purchase.

Review – a written evaluation made by the User regarding a Product available on https://www.micul-fermier.ro.

Commercial Communications – any type of message sent by electronic means of communication and/or by any other available means of communication that contains commercial communications or invitations to participate in opinion surveys.

Micul Fermier – the online platform through which E-fishent makes available exclusively to consumers, as defined by consumer protection legislation, the Products available on https://www.micul-fermier.ro.

Product – any product listed on https://www.micul-fermier.ro that the Seller supplies through https://www.micul-fermier.ro.

User – any natural or legal person who visits and/or interacts with https://www.micul-fermier.ro.

Consumer – a User who is a natural person at least 18 years of age, who has created an Account on https://www.micul-fermier.ro and who places an Online Order on https://www.micul-fermier.ro or who places a Telephone order and who has agreed to the specific clauses of the website in the Terms and Conditions section.

Seller – E-fishent SRL.

 

III. User Registration

The Micul Fermier online platform and the subsection https://www.micul-fermier.ro can be accessed free of charge, and simply browsing their pages is not conditional upon registration as a User.

In order to benefit from the Products sold on https://www.micul-fermier.ro, as well as related services, registration as a User is required, or an order can be placed without registration as a User, with the note that it will be necessary to provide data for billing and product delivery.

Registration as a User requires prior acceptance of these terms and conditions of use of https://www.micul-fermier.ro (“Terms and Conditions”) and of the Privacy Policy. These constitute the contractual basis of the relationship between the User and the Seller.

As the provisions of the Terms and Conditions and the Privacy Policy may be amended, please review them periodically. If you no longer agree with their provisions, please refrain from accessing/using https://www.micul-fermier.ro.

If you use https://www.micul-fermier.ro, you are responsible for maintaining the confidentiality of your User Account access data and you assume responsibility for all activities carried out from the User Account.

 

IV. Purchasing Procedure

In order to purchase and take possession of the Products offered for sale on https://www.micul-fermier.ro, the following steps must be completed:

  • Registration as a User of https://www.micul-fermier.ro;
  • Identifying and selecting the Products and adding them to the Cart;
  • Ordering the selected Products;
  • Payment for the Products. Payment is made online at the time of placing the Order, through an installment payment system, cash on delivery at the time the Products are delivered by the courier, or by payment order. The final cost will include the price of the ordered Product with VAT included, the green stamp price, if applicable, as well as the delivery price, if applicable. If the value of the ordered Products is a minimum of 700 Lei, delivery of the Products is free of charge. If the value of the ordered Products is less than 700 Lei, the User shall bear the delivery cost.
  • Delivery of the ordered products. These will be accompanied, if applicable, by the warranty certificate, the certificate regarding the after-sales service provided by the manufacturer/importer/distributor and/or other certificates, if applicable, as well as fiscal documents, in accordance with the legislation in force.
  • Available from supplier = stock of more than 10 units
  • Limited stock = stock between 1 and 10 units
  • Out of stock = 0 stock
  • In the case of online payment: the transaction was not accepted by the issuing bank of the User’s card; the transaction was invalidated by the card processor approved by the Seller.
  • The data provided by the User on https://www.micul-fermier.ro is incomplete and/or incorrect.
  • Online payment;
  • Cash on delivery;
  • Payment order (bank transfer);
  • Payment in installments.
  • the day on which the consumer or a third party, other than the carrier and designated by the consumer, takes physical possession of the goods;
  • the day on which the consumer or a third party, other than the carrier and designated by the consumer, takes physical possession of the last Product – in the case where the consumer orders multiple products through a single Order which will be delivered separately;
  • the day on which the consumer or a third party, other than the carrier and designated by the consumer, takes physical possession of the last Product or the last piece – in the case of delivery of a Product consisting of multiple lots or pieces.
  • completing the online withdrawal form available on https://www.micul-fermier.ro – https://www.micul-fermier.ro/conditii-de-retur;
  • sending the withdrawal form by post to the seller’s registered office;
  • sending, by any means chosen by the consumer, an unequivocal statement (for example, a letter, an email) expressing the decision to withdraw from the contract.
  • The Products are non-conforming with the specifications on the website;
  • The Products were erroneously delivered by the seller;
  • The Products prove to be non-conforming within the warranty or validity period;
  • Malfunctions of the technical equipment used by the Seller in carrying out its activity, including those caused by computer viruses, unauthorized access to the Seller’s systems, or operational errors;
  • Lack of internet and telephone connectivity;
  • Force majeure situations stipulated by the legislation in force.

The Seller makes every effort to be as accurate as possible in the description of the Products. However, it does not guarantee that the descriptions of the Products or other types of materials related to them are accurate, complete, current, or error-free.

The information used to describe the Products available on https://www.micul-fermier.ro does not constitute a contractual obligation on the part of the Seller, being used exclusively for presentation purposes.

All prices for the Products presented on https://www.micul-fermier.ro are expressed in Lei and include VAT, as well as any other legal taxes (green stamp tax), if applicable.

The Seller shall ensure the proper packaging of the Products and shall deliver the Products only on the territory of Romania.

The Seller shall deliver the Products within a maximum of 3 business days for products that can be shipped through postal or courier services and within a maximum of 5 days for oversized products.

Ownership of the Products shall be transferred upon delivery, after payment has been made by the User.

By placing an Order on https://www.micul-fermier.ro or by telephone, you agree to the form of communication (telephone or email) through which the Seller conducts its activity.

The Buyer has the right to post a Review on https://www.micul-fermier.ro regarding the purchased Product.

 

Order processing and delivery schedule:

Orders can be placed online at any time, but the processing period takes place daily, on business days from Monday to Friday, inclusive, between 7:30 AM and 4:00 PM.

Orders can be placed by telephone on business days from Monday to Friday, inclusive, between 7:30 AM and 4:00 PM, at phone number: 0374 496 500 (standard rate telephone line).

Orders placed online on Saturdays, Sundays, and public holidays will be processed on the next business day.

 

V. Order

The User may place Orders on https://www.micul-fermier.ro by adding the desired Products to the Cart.

A Product added to the Cart is available for purchase insofar as there is available stock. Adding a Product to the Cart does not result in the registration of an Order, nor does it automatically reserve the Product.

Product availability is determined automatically based on an algorithm, and one of the following options will be displayed on https://www.micul-fermier.ro:

 

The information provided by the User in the placed Order is necessary for the correct and efficient processing of the Order. The User is obligated to correctly complete the Order form and to indicate the persons to whom billing and delivery are to be made. The email address is very important as information related to the Order will be sent by email.

If the delivery address is not the same as the billing address, the User is obligated to indicate this in the Order form. If the delivery address or billing address, or both, are not the same as the address registered in the User Account, the User is obligated to enter the valid billing and/or delivery addresses for the respective Order.

By placing the Order, the User guarantees that all data provided by them, necessary for the purchasing process, is correct, complete, and true at the date of placing the Order.

Following the placement of the Order, the Seller will confirm receipt of the Order to the User by sending an email to the email address available in the User Account.

If the Order is placed by telephone, the Seller may and will request the User to pay a deposit at the time of the Order.

The Seller may cancel the Order placed by the User, following prior notification to the User, without any further obligation of either party to the other, or without either party being able to claim damages from the other, in the following cases:

For justified reasons, the Seller reserves the right to modify the quantity of Products in the Order with notification to the User at the email address or telephone number provided to the Seller, and will refund the amount paid for the Products removed from the Order.

 

VI. Payment Methods

To make payment for the ordered Products, you may choose from the following payment methods:

 

If the User chooses online payment as the payment method, the Seller will send the relevant information for payment. This information will also be included in the invoice that will be sent to the email address used in the relationship with the Seller.

In the case of online payments, the Seller is not and cannot be held responsible for any additional costs incurred by the User, including but not limited to currency conversion fees applied by the issuing bank of the User’s card, in the event that the currency of issuance differs from the Romanian Leu. Responsibility for this lies with the User.

The User’s payment card data will not be accessible to the Seller nor stored by the Seller, but rather by the payment processor integrated into https://www.micul-fermier.ro, an entity authorized to provide card identification data storage services, whose identity the User will be informed of prior to entering the data.

If the User chooses cash on delivery, after placing the Order, the Seller will send by email or include in the parcel the invoice for the ordered Products containing the relevant information regarding the Order, and payment shall be made upon delivery.

For proper communication of the invoice related to the Order, the User is obligated to update the data in the User Account whenever necessary.

Invoices will be sent to the User via email, to the email address indicated in the Account, or in physical format, included in the parcel.

 

VII. Right of Withdrawal from a Distance Contract and Return of Products after Contract Withdrawal

In accordance with the provisions of Emergency Government Ordinance (EGO) no. 34/2014 on consumer rights in contracts concluded with professionals, as well as for the amendment and completion of certain normative acts, the consumer – a natural person or a group of natural persons organized in associations, as defined in Art. 2 para. 2 of Government Ordinance no. 21/1992 on consumer protection, republished, with subsequent amendments and additions – has the right to withdraw from the Contract and to return a Product purchased online (through a distance contract) within 14 calendar days, without giving any reason and without incurring any costs other than the direct costs of returning the products for which a return is requested.

Legal entities do not benefit from the provisions on contract withdrawal in accordance with the provisions of EGO no. 34/2014.

The withdrawal period from the Contract expires within 14 calendar days calculated from:

The 14 calendar day period above must be observed by the consumer; otherwise, the consumer will lose the right of withdrawal from the contract, as provided by the provisions of EGO no. 34/2014.

 

If the consumer decides to withdraw from the Contract, they must inform the Seller, before the expiry of the withdrawal period, of the decision to withdraw from the contract, through one of the following options:

In any situation where the unequivocal declaration of withdrawal is communicated or the aforementioned form is submitted duly completed, by post or to the email address, we will confirm receipt thereof by email, to the address provided at the time of placing the order.

The use of the aforementioned form is not mandatory, but is a recommendation for the optimal conduct of the return procedure.

 

The consumer returns the products within a maximum of 14 calendar days from the date on which they communicated to the Seller their decision to withdraw from the Contract. The deadline is met if the products are sent back by the consumer before the expiry of the 14 calendar day period.

The cost of return is NOT borne by the Seller; all direct costs related to the return of the products, including the transport cost, are borne by the consumer and are not refundable.

The Seller shall collect the products at its own expense if the products, by their nature, cannot normally be returned by post/courier.

The Seller shall refund all amounts received as payment from the Consumer, to the bank account indicated by the Consumer in the return form, within a maximum of 14 calendar days from the date on which the Seller is informed of the Consumer’s decision to withdraw from the Contract. The Consumer shall not bear any commission as a result of the refund.

The Seller shall not refund the additional delivery costs if the Consumer, at the time of purchase, explicitly chose a type of delivery other than the standard delivery offered by the Seller.

The Seller may delay the refund until the date of receipt of the Products or until the moment of receiving proof from the Consumer that the Products have been sent to the Seller, whichever date is earlier.

The Consumer is obligated, upon returning the Product, to also return any gifts that accompanied the respective Product, if applicable, as well as all its accessories.

The Consumer has the right to test and verify the purchased Products to the extent necessary to establish their nature, characteristics, and manner of operation. In this case, the Consumer is obligated to handle and inspect them in the same manner as would be permitted in a physical retail store.

The Consumer is responsible for any diminution in the value of the Products resulting from handling of the Product other than what is necessary for determining its nature, qualities, and functioning.

 

RETURN OF PRODUCTS FOR LACK OF CONFORMITY

 

The User may request the return of non-conforming products purchased in the following situations:

If the ordered product proves not to conform to the specifications in the offer presented on the website, the Consumer may request its return for replacement or a full refund of the amount paid. The costs of return and transport for the replacement product, if applicable, are borne by the Seller.

In the event that the Consumer opts for replacing the product with another product of a higher value, they shall pay the difference, and if the value of the replacement product is lower, the Consumer shall receive a partial refund, namely the difference between the original product and the replacement product.

The products delivered to the Consumer do not correspond in brand, category, or model with the product ordered by the User.

In the event that the Seller has erroneously delivered a product other than the one ordered by the Consumer, the Consumer shall report this as soon as possible in order to return the product and have it replaced with the correct one. All costs of return and transport of the correct product shall be borne by the Seller.

 

The Seller is liable to the consumer for any non-conformity that exists at the time of delivery of the goods and that is established within two years from that date.

In the event of non-conformity, the consumer has the right to have the goods brought into conformity, to benefit from a proportional reduction in price, or to obtain termination of the contract under the conditions provided by law.

In order for the goods to be brought into conformity, the consumer may choose between repair and replacement, except where the corrective measure chosen would be impossible or, in comparison with the other available corrective measure, would impose costs on the seller that would be disproportionate, taking into account all circumstances, including the following:

a) the value of the goods if there had been no non-conformity; b) the severity of the non-conformity; or c) whether the alternative corrective measure could be carried out without significant inconvenience to the consumer.

The Seller may refuse to bring the goods into conformity if repair or replacement is impossible or would impose costs that would be disproportionate, taking into account all circumstances, including those mentioned above.

The consumer does not have the right to obtain termination of the contract if the non-conformity is minor.

Consumers benefit from replacement of the goods in cases where their non-conformity is established shortly after delivery, not exceeding 30 calendar days.

Repairs or replacements are carried out in compliance with the following conditions: a) at no cost; b) within a reasonable period that cannot exceed 15 calendar days from the moment the seller was informed by the consumer about the non-conformity, established by mutual written agreement between the seller and the consumer, taking into account the nature and complexity of the goods, the nature and severity of the non-conformity, and the effort required to complete the repair or replacement; c) without significant inconvenience to the consumer, taking into account the nature of the goods and the purpose for which the consumer requested the goods in question.

The price reduction is proportional to the diminution in value of the goods received by the consumer compared to the value the goods would have had if they had been in conformity.

In the event that the consumer obtains the termination of the sales contract under the conditions provided by law, in its entirety or in relation to some of the goods delivered under the sales contract: a) the consumer returns the goods to the seller, at the latter’s expense; b) the seller refunds the consumer the price paid for the goods upon receipt of the goods or of proof presented by the consumer that the goods have been returned; c) the seller refunds the consumer the amount of money using the same payment methods used by the consumer for the initial transaction, unless the consumer has agreed to a different payment method, without the consumer being charged any commission as a result of the refund.

 

VIII. Warranty and After-Sales Service

All Products available on https://www.micul-fermier.ro benefit from the legal warranty offered in accordance with the legislation in force, for a period of 24 months.

On the page of each Product available on the website, the Seller publishes the Product User Manual, which includes the warranty certificate with all the details necessary to benefit from the warranty.

 

IX. Reviews, Comments, Communications, and Other Types of Content

Users may publish on https://www.micul-fermier.ro reviews, comments, send suggestions, ideas, ask questions, provided that their content is not illegal, obscene, threatening, defamatory, does not infringe intellectual property rights, does not contain computer viruses, commercial communications, is not of a political nature, and does not incite hatred or intolerance on ethnic, religious, racial, or sexual orientation grounds. If the Seller finds a breach of this obligation by the User, it has the right to close the User’s Account. The Seller has the right not to publish all comments and reviews submitted by the User.

For publication on https://www.micul-fermier.ro, the User is obligated not to use false email addresses or false identities.

The Seller reserves the right, but is not obligated, to remove or edit all types of reviews and comments published by Users.

By publishing reviews and comments on https://www.micul-fermier.ro, the User transfers to the Seller the intellectual property rights over the published materials, exclusively, perpetually, irrevocably, and without territorial limitation.

By posting reviews, comments, and communications on https://www.micul-fermier.ro, the User: grants the Seller the right to use the User’s name in connection with the published materials; guarantees that the User holds the intellectual property rights over the materials they publish; guarantees that the published materials do not violate the conditions for publishing reviews and comments on https://www.micul-fermier.ro.

The Seller has the right to modify, reproduce, transmit, adapt, publish, and distribute the materials published by Users on https://www.micul-fermier.ro.

The Seller is not responsible and does not assume responsibility for materials published on https://www.micul-fermier.ro by other third parties.

 

X. Assignment and Subcontracting

The Seller has the right to assign and/or subcontract a third party for the provision of services related to the fulfillment of Orders, remaining responsible to the User for all contractual obligations.

 

XI. Limitation of Liability and Force Majeure

The Seller is not responsible for damages of any kind that the User or any third party may suffer as a result of the Seller’s fulfillment of any obligation pursuant to the Order, and for damages resulting from the use of the Products.

The Seller, its affiliates, and/or, in general, the Seller’s Product or service suppliers cannot be held responsible for any delay or error resulting directly or indirectly from causes beyond the control of the Seller or its affiliates and/or suppliers.

This exemption includes, but is not limited to:

Neither party shall be liable for the non-performance of its contractual obligations if such non-performance, in whole or in part, is due to a force majeure event.

If within 15 (fifteen) business days from the date of its occurrence the respective event does not cease, each party shall have the right to notify the other party of the termination by operation of law of the Contract, without either party being able to claim damages from the other.

 

XII. Intellectual Property

The content and design of the Micul Fermier online platform, including but not limited to logos, stylized representations, commercial symbols, static images, dynamic images, text and/or multimedia content presented on the Micul Fermier online platform, as well as any other material related thereto sent to the User by email or provided by any other means (e.g., articles, design, product descriptions, and any other materials), belong to the entities of the Micul Fermier group and/or its collaborators – where this is expressly specified – and are protected by intellectual property legislation.

The User may not use, reproduce, or allow anyone to use or reproduce the content and design of the Micul Fermier online platform, as well as any other material related thereto, without prior written permission from the entities of the Micul Fermier group.

The User may not use frames (in the HTML sense) or framing techniques (in the HTML sense) for trademarks, logos, or other information protected by copyright law (including images, texts, interfaces, forms) of the entities of the Micul Fermier group without prior written permission from the entities of the Micul Fermier group.

The limited, revocable, and non-exclusive creation of hyperlinks to the index page of https://www.micul-fermier.ro is permitted, as long as this action does not present the https://www.micul-fermier.ro service in a false, misleading, derogatory, or offensive light.

The User may not use the logo of the entities of the Micul Fermier group or other graphic properties or trademarks as part of hyperlinks without prior written permission from the entities of the Micul Fermier group.

The User does not have the right to copy, distribute, publish, transfer to third parties, modify and/or otherwise alter, use, link to, display, include any content in any context other than the one originally intended by the entities of the Micul Fermier group, to include any content outside the Micul Fermier online platform, to remove the markings signifying the copyright of the entities of the Micul Fermier group over the content, or to participate in the transfer, sale, or distribution of materials created through the reproduction, modification, or display of the content, except with the express written consent of the entities of the Micul Fermier group.

The Seller respects the intellectual property rights of third parties. If you have noticed that https://www.micul-fermier.ro contains information that infringes the intellectual property rights of third parties, please send us a notification to the email address or contact us at the telephone number or mailing address displayed on https://www.micul-fermier.ro.

 

XIII. Personal Data Protection

Upon registration as a User of https://www.micul-fermier.ro, the Seller requests a series of personal data from the User, such as first and last name, email address, billing address, delivery address, telephone number, date of birth, as well as other personal information that allows the identification of the User.

Additionally, in order to subscribe to the newsletter provided by the Seller, the User must provide a valid email address and express their consent in this regard.

The User may access the page dedicated to the Privacy Policy to learn about the personal data processed by the Seller, as well as the rights recognized by data protection legislation.

 

XIV. Applicable Law

These Terms and Conditions are subject to Romanian law and are supplemented by the applicable legal provisions.

In the event of a dispute, the Seller and the User shall attempt to resolve it amicably within 30 business days from the moment the Seller or the User communicates the potential dispute to the other.

If an agreement cannot be reached within the aforementioned period, disputes between the Seller and the User shall be submitted for resolution to the competent courts.

 

XV. Offer Presentation and Updates to the Terms and Conditions

The Seller reserves the right to make unilateral changes at any time to the prices and technical data on https://www.micul-fermier.ro, without prior notice to the User. The technical data on https://www.micul-fermier.ro is of an informational nature and does not constitute a contractual obligation. The photographs on https://www.micul-fermier.ro are of an informational nature and there may be differences between them and the Product.

If in the future it becomes necessary to revise the Terms and Conditions, the Seller will publish the revised version on https://www.micul-fermier.ro. The User is obligated to periodically check the content of these Terms and Conditions.
